These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player", "User", or "you") and 43winph ("43winph", "we", "us", or "our"), which operates the online gaming platform accessible at 43winph.club (the "Platform").

If 43winph determines at any time that a player is or was under 21 years of age, the account will be immediately and permanently closed. You are solely responsible for maintaining the confidentiality of your 43winph login credentials, including your username, password, and any two-factor authentication (2FA) codes. You agree to:

43winph employs SSL encryption, brute-force login protection, and optional 2FA via SMS OTP to protect your account. You are strongly encouraged to enable 2FA. However, the use of these security features does not transfer responsibility for account security away from you.

43winph accepts deposits via the following methods: GCash, Maya (formerly PayMaya), BPI, BDO, Metrobank, Coins.ph, 7-Eleven, and USDT. The minimum deposit is ₱100 Philippine Peso. No platform-side deposit fees are charged by 43winph; however, your payment provider may apply their own transaction fees independently.

All deposits must comply with the following conditions:

• Own Account Only: All funds deposited into your 43winph account must originate from a payment method registered in your own name. Deposits from GCash or Maya accounts, bank accounts, or e-wallets belonging to another person are not permitted and will be returned to the source.

• Attempting to reverse-engineer, hack, or otherwise interfere with the technical operation of the Platform;

Detection will result in immediate account suspension, investigation, and, where evidence supports it, permanent account termination with forfeiture of balances. 43winph reserves the right to refer confirmed instances of fraud or criminal conduct to the appropriate Philippine government authorities.

To the maximum extent permitted by Philippine law, 43winph's total aggregate liability to you in connection with your use of the Platform — whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total amount deposited by you to your 43winph account in the twelve (12) months immediately preceding the event giving rise to the claim.

43winph shall not be liable for:

• Loss of profits, loss of data, or any indirect, consequential, special, or punitive damages;

Nothing in these Terms excludes or limits 43winph's liability for death or personal injury caused by its negligence, or for any other liability that cannot be excluded or limited under Philippine law.

43winph collects, processes, and stores personal data about registered players in accordance with Republic Act No. 10173 (Data Privacy Act of 2012) and its implementing rules and regulations. By registering on 43winph, you acknowledge and consent to the processing of your personal data as described in the Privacy Policy. You have the right to access, correct, object to, and request the deletion of your personal data, subject to applicable legal retention obligations.

43winph does not sell your personal data to third-party advertisers. Data is shared only where necessary for the operation of the Platform (e.g., with payment processors, KYC verification providers, and PAGCOR where required by regulation).

43winph reserves the right to amend, update, or replace these Terms at any time. These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of laws principles.

Any dispute between you and 43winph arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Metro Manila, Philippines, unless otherwise required by mandatory consumer protection provisions applicable to your specific situation.
